Glamour on the Bay Terms & Conditions
1. CONTRACT: The Contract for a short-term holiday rental shall be made between the Client and Folley A Australia Pty Ltd. The Contract shall be governed by Australian Law. It will be entered into when the deposit is processed and Folley A Australia Pty Ltd issues the confirmation letter. The Contract will be subject to all the following booking conditions
2. PAYMENT: A bond of $500.00 is payable for two nights which is repaid within the following week. A bond of $1000. is payable for three or more nights and again returned within the week as long as there is no damage. 10% of the holiday cost is to be sent with your booking. Payment in full is to be paid 6 weeks before the commencement of the rental. For bookings made less than 6 weeks before the commencement of the holiday, the total fee is payable on booking. Non-payment of the rent 6 weeks before the holiday will be construed as a cancellation by the client. All payments shall be made to Folley A Australia Pty Ltd.
3. CANCELLATION: Any cancellation made by the client shall be in writing (email). If the booking is cancelled within 2 weeks of the arrival date, then the entire fee will be forfeit. For cancellations made prior to two weeks of the commencement of the holiday, a percentage of the rental fee will be refundable. This will be according to a sliding scale as follows: 6 weeks before holiday, complete refund. 4 weeks before holiday, 40% deducted .2 weeks before holiday, no refund. However if a cancelled booking can be resold, at short notice, the entire holiday will be refunded even if notice is given with only 2 weeks to go until the holiday starts. If only part of the holiday is sold then only part will be refunded and the rest will be deducted. Cancellation Insurance is highly recommended. You may wish to take out your own insurance with a company you know.
4. PERIOD OF HIRE: Rentals commence, unless otherwise notified, at 2pm on the day of arrival and terminate at
10am on the day of departure.
5. NUMBERS OF PERSONS IN THE PROPERTY: The number of people occupying the property must not exceed the maximum number stipulated in the brochure and on the website. Folley A Australia Pty Ltd reserves the right to refuse entry to the entire party if this condition is not observed. Also if it is found out that more than the maximum number allowed stayed at the premises, the bond will become forfeit.
6. COMPLAINTS: Should there be any cause for complaint during the occupation of the property, it must be notified promptly to Folley A Australia Pty Ltd. In the case of a serious problem, this should be confirmed in writing.
7. CARE OF PROPERTY: The Client shall take all reasonable and proper care of the property, and its furniture, fittings and effects, in or on the property. Please leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning.
8. BREAKAGES OR DAMAGE: The Client is legally bound to reimburse Folley A Australia Pty Ltd for replacements, repairs or extra cleaning costs on demand.
9. PETS: Folley A Australia Pty Ltd regrets that no pets are allowed on or in the property.
10. LIABILITY; Folley A Australia Pty Ltd , its employees and agents does not accept third party liability in respect of breach of contract, negligence, misrepresentation or otherwise.
11. RIGHT OF ENTRY: Folley A Australia Pty Ltd shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or carry out any necessary repairs or maintenance.
12. CHILDREN: Guests must accept responsibility for the safety of their children at all times. No child may be unaccompanied in the lift or the Spa. Foster Terms and Conditions
